Nationwide Freight Service – Terms and Conditions
Acceptance of Terms
By signing or otherwise accepting this agreement, you (“Client,” “you”) acknowledge that you have read, understood, and agree to be bound by all the terms here. If you don’t agree, you may not use Nationwide Freight Service’s (“we,” “us,” “NFS”) services.
Our Role / Services
Nationwide Freight Service acts solely as a freight broker: we connect you with a carrier (“Carrier”) for the purpose of shipping your vehicle (or other shipment, if applicable). We do not take physical possession of your shipment.
Our services are considered delivered once we have formally assigned a Carrier to your order.
Fees / Payment
- You agree to pay the full quoted amount for services, plus any additional charges that might arise under this agreement.
- You will pay an initial deposit (by credit/debit card) when booking. By submitting your payment info, you authorize NFS to charge the deposit immediately.
- The final balance (plus any additional charges) must be paid directly to the Carrier (in cash, money order, or certified check) when your shipment is delivered.
- If you don’t pay the remaining balance at delivery, your shipment may be stored at your expense until it’s paid in full.
- All amounts are due when due; they’re not subject to dispute or set-off for any reason (including dissatisfaction).
- Once paid, these charges are generally non-refundable.
- If you miss a payment, or if there’s a chargeback, you will owe us the outstanding amount plus any reasonable collection costs, legal fees, or interest (e.g., 1% per month or the highest rate allowed by law).
Cancellation / Refunds
- You can change your order before a Carrier is assigned. But changes may lead to extra fees — and if you don’t accept those, the order could be canceled.
- Your deposit is refundable only if you cancel before we dispatch a Carrier.
- Once a Carrier is dispatched, the services are considered rendered, and your deposit becomes non-refundable.
- If you cancel after a Carrier has been dispatched, you’ll be charged a cancellation fee equal to 100% of the total cost. This covers lost trucking space, fuel, and “dead” mileage.
- Orders cannot be canceled or changed once the Carrier has picked up your vehicle/shipment.
- All cancellations and change requests must be submitted in writing (e.g., via email) to our support team.
- After a refund is processed, please allow 5–7 business days for the funds to appear in your account.
- We ask that you avoid initiating a bank chargeback if we’ve processed your refund, because that can lead to further costs or delays.
Booking and Shipment Details
- To book, you must provide accurate information about your shipment (vehicle details, pick-up & delivery addresses, dates, whether the vehicle runs, etc.), who will be on-site for pick-up/delivery, and how you want to transport (open vs enclosed, for example).
- After you submit your info, we’ll send a “Verification Email” that includes a copy of this agreement and a breakdown of fees. You must review and confirm.
- Once a Carrier is assigned, we’ll notify you by email. That email will include information about the Carrier and estimates for pick-up and delivery.
- We cannot guarantee a specific driver or Carrier; rather, we’ll work with licensed Carriers on our network.
- Carriers may try to contact you before pick-up or delivery to coordinate times and locations, but pickup or drop-off may not be exactly at your requested physical address. Due to safety, regulatory, or routing constraints, alternative locations (nearby commercial truck-friendly sites like big-box stores) may be used.
- If you aren’t available at pick-up or delivery, you should designate someone to act on your behalf and inform us who that is.
- Once you accept this agreement, you agree not to contract with another broker for the same shipment during the time that NFS is working on it. If we find evidence that you are concurrently working with other brokers, we reserve the right to cancel your booking and forfeit your deposit.
- Any personal items placed in the vehicle must be stored in the trunk, weigh no more than 120 lbs (or as otherwise agreed), and be safe & legal. Overweight or improperly loaded items may incur additional fees, and the Carrier is not liable for damage to those items.
- Before pick-up: make sure your vehicle is in working order (unless noted), has between ¼ and ½ tank of fuel, and that you remove all dangerous, illegal, sensitive, or high-value items (e.g., weapons, legal documents, plants, pets, contraband).
- If there’s an alarm system, give the Carrier keys + disarm instructions.
- We and the Carrier are not responsible for damage resulting from your failure to follow these preparation requirements.
Transit / Transportation
- By accepting the order, you authorize the Carrier to operate and transport your shipment as needed. The Carrier may, if necessary, drive the vehicle (covered by their insurance or yours, if applicable).
- The Carrier’s liability begins when you and the Carrier sign the Bill of Lading (BOL) at pickup and ends when you sign the BOL at delivery (or otherwise accept your shipment).
- You should always inspect the vehicle (or shipment) and sign a thorough inspection report / BOL at both pickup and delivery. Without that, it may limit your ability to file a damage claim.
- While we aim for timely service, pickup and delivery dates/times are only estimates — they’re subject to change due to weather, road conditions, mechanical problems, or other factors outside our control. We do not guarantee exact times or locations.
No-Show / Alternative Arrangements
- We strongly encourage you (or someone you designate) to be present at both pickup and delivery.
- If neither you nor your designee shows up, or you arrange for shipment without being present, you waive certain rights — including the right to inspect and note damage.
- In such cases, NFS is not responsible for damage or loss, and you may be asked to sign additional waivers or make other delivery arrangements.
Damages, Liability & Insurance
- Carriers are required to maintain insurance (cargo, liability, etc.). However, all damage claims must be noted on delivery, signed for, and submitted in writing (typically within 15 days of delivery).
- Any damage during transport is the Carrier’s responsibility — not NFS’s.
- While we may request proof of the Carrier’s insurance coverage, we rely on the documentation they provide (or from their insurer or the DOT) without independently verifying every detail.
- You may not withhold payment or offset charges for damage under this agreement. All fees must still be paid in full, and you must file any damage claims separately.
- NFS disclaims liability for any loss or damage to your shipment, your personal property, or any other property, except as required by applicable law or Carrier insurance. When a Carrier is assigned, you will receive a copy of their Certificate of Insurance.
Indemnification
You agree to indemnify, defend, and hold harmless Nationwide Freight Service, its officers, agents, and the Carrier from any claims, losses, costs, or expenses (including legal fees) resulting from your breach of this agreement or misuse of our services.
Miscellaneous
- We may cancel your order or terminate this agreement at any time, for any reason, without further obligation.
- Our right to cancel includes events beyond our control: acts of God, natural disasters, epidemics/pandemics, government orders, etc.
- This agreement is governed by [your chosen state law here — you’ll need to decide which state and insert it].
- If any part of this agreement is found to be invalid, the rest remains in effect.
Agreement Acknowledgment
By agreeing, you certify that:
- You have read and understood this entire agreement.
- This contract is between you and Nationwide Freight Service (not between you and the Carrier directly, unless otherwise stated).
- If you cancel before a Carrier is dispatched, your deposit is refundable; but once a Carrier is assigned and dispatched, the deposit is non-refundable.
